By accessing or using this website and its WHMIS training course (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service. We reserve the right to update these Terms at any time without prior notice. Continued use of the Service after changes constitutes acceptance of the revised Terms.

2. Nature of the Service

This Service provides general WHMIS education based on publicly available information from Health Canada, the Canadian Centre for Occupational Health and Safety (CCOHS), and the Hazardous Products Regulations (HPR). The content reflects legislation as of the December 2022 amendments to the Hazardous Products Regulations (aligning with GHS Revision 7).

This course is designed to provide general awareness-level WHMIS education. It is not a substitute for workplace-specific training that employers are legally required to provide under federal and provincial/territorial occupational health and safety legislation.

3. No Guarantee of Regulatory Compliance

While we strive to ensure accuracy, we do not guarantee that this course satisfies all legal requirements for WHMIS training in any specific province, territory, or workplace. WHMIS training requirements vary by jurisdiction and employer. It is the responsibility of the employer and the worker to ensure that all applicable training requirements are met, including workplace-specific hazard training.

The certificate issued upon completion of this course confirms that the user has completed the online educational content provided. It does not constitute a government-issued certification, nor does it guarantee compliance with any specific employer, provincial, territorial, or federal training mandate.

4. Limitation of Liability

To the fullest extent permitted by applicable law, the operators of this Service, including its owners, employees, contractors, affiliates, and agents (collectively, “we” or “us”), shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to:

  • Your use of, or inability to use, the Service
  • Any errors, inaccuracies, or omissions in the course content
  • Any workplace injury, illness, regulatory penalty, or other harm arising from reliance on the content provided
  • Any failure to meet employer-specific or jurisdiction-specific training requirements
  • Any interruption, suspension, or termination of the Service
  • Any unauthorized access to or alteration of your data

You use this Service entirely at your own risk. In no event shall our total liability exceed the amount you paid for the course.

5. Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, completeness, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

6. Employer Responsibilities

Under Canadian law, employers are responsible for ensuring that workers receive adequate WHMIS training, including workplace-specific training on the hazardous products present in their particular work environment. This online course provides general WHMIS education only. Employers must provide additional site-specific training covering the specific hazardous products, procedures, and emergency protocols relevant to their workplace.

7. Content Accuracy and Updates

Course content reflects the Hazardous Products Regulations as amended in December 2022 (GHS Revision 7). Regulations may change over time. While we endeavour to keep the content current, we do not guarantee that the content reflects the most recent legislative amendments at the time of your access. Users are encouraged to consult official sources such as Health Canada and CCOHS for the latest regulatory information.

8. Payment and Refund Policy

Access to the course requires a one-time payment of $9.99 CAD. All payments are processed securely through Stripe. Due to the digital nature of the Service, all sales are final once course access has been granted. If you experience technical issues preventing access, please contact us for assistance.

9. Intellectual Property

All course content, design, graphics, and materials are the property of the Service operators or are used under applicable fair dealing provisions for educational purposes. You may not reproduce, distribute, or commercially exploit any content without prior written consent. The certificate generated upon course completion is for your personal use and may not be altered or falsified.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Service operators from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.

12. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
